Terms of Service

Last updated: October 21, 2026

These Terms of Service ("Terms") are an agreement between you and UGC Mediakits ("Weight Class", "we", "us" or "our"). They govern your use of the Weight Class mobile app, this website and any related services (together, the "Service"). Please read them carefully.

1. Accepting these Terms

By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Our Privacy Policy explains how we collect and use personal information when you use the Service. Please read it alongside these Terms.

If you are a parent or legal guardian allowing a minor to use Weight Class, you agree to these Terms on their behalf and are responsible for their use of the Service.

2. Who can use Weight Class

To use Weight Class, you must:

  • be at least 18 years old;
  • if the age of majority where you live is higher than 18 and you are under it, have the permission of a parent or legal guardian who has read and agreed to these Terms; and
  • not be prohibited from using the Service under the laws that apply to you.

Calorie tracking is not appropriate for everyone. Please read Section 6 before you start.

3. Your account

You create a Weight Class account and sign in with your email address and a password. To create an account, you must meet the requirements in Section 2, including the minimum age of 18. We store only a secure, one-way hash of your password, never the password itself (see our Privacy Policy). When you create an account, you agree that:

  • the information you provide, including your name, email address and onboarding answers, is accurate and kept up to date;
  • your account is personal to you, and you will not share it or let anyone else use it;
  • you will keep your password secret, use a password that you do not use for any other service, and keep your device secure;
  • you are responsible for activity that happens under your Weight Class account; and
  • you will tell us promptly at support@ugcmediakits.com if you believe someone has accessed your account without permission.

Weight Class cannot reset passwords by email yet. If you forget your password or lose access to your account, contact us at support@ugcmediakits.com. We may ask you for information to confirm that the account is yours.

4. The Service

Weight Class helps you track what you eat. Based on your answers to a few onboarding questions, Weight Class uses AI to suggest daily targets for calories, protein, carbohydrates and fat. You can then photograph your meals, and Weight Class uses AI to estimate what they contain and tracks them against your targets, together with your history and streaks.

We are constantly improving Weight Class, so we may add, change or remove features. If we make a change that significantly reduces what the Service does for you, we will try to let you know in advance.

We work hard to keep Weight Class available, but we do not promise that it will always be available, uninterrupted or free of errors. The Service depends on your internet connection and on third-party providers, and we may pause it for maintenance, security or other reasons.

5. AI-generated estimates

Your plan and your meal analyses are generated automatically by AI models run by our service providers. These outputs are estimates, and they may be inaccurate or incomplete. For example, the AI may misjudge portion sizes, miss hidden ingredients such as oil, butter or sugar, misidentify a dish, or decide that a photo does not show food. Lighting, camera angle and mixed dishes can all affect the result.

You are responsible for how you use these estimates. In particular:

  • review each estimate and correct it in the app when it looks wrong;
  • never rely on Weight Class to calculate medication doses (such as insulin), to manage a medical condition or to check food for allergens or intolerances;
  • treat the pen and vial counts and use-by dates in GLP-1 mode, the weekly check-in and Plan tomorrow's drafts as estimates from what you entered and logged: follow your prescriber's and pharmacist's instructions for your medicine, and check changes to how you eat with a health professional; and
  • do not treat the numbers in Weight Class as exact measurements or as a guarantee of any result, such as losing or gaining a certain amount of weight.

6. Not medical advice

Weight Class is designed for general information and wellness purposes. It is not a medical device and does not provide medical, nutritional or dietary advice, diagnosis or treatment. Nothing in the Service replaces the advice of a doctor, registered dietitian or other qualified health professional.

Talk to a qualified health professional before starting a diet or changing how you eat, especially if you are pregnant or breastfeeding, are under 18, have a medical condition (such as diabetes, heart disease or kidney disease), take medication, or have or have had an eating disorder. If using Weight Class makes you feel anxious about food or contributes to unhealthy habits, please stop using it and seek professional support. In an emergency, contact your local emergency services.

7. Your content

"Your content" means everything you add to the Service, including meal photos, progress photos, onboarding answers, meal names and values you edit, and feedback you send us. You keep all ownership rights you have in your content.

To run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, analyze, adapt (for example, resize or compress) and display your content, and to let our service providers, including our AI providers, do the same on our behalf. We use this license only to operate, secure and improve the Service for you and as described in our Privacy Policy. We will not use your photos in marketing or make them public without your permission, and we never share your progress photos with AI providers.

This license ends when you delete the content or your account, except for residual copies kept for a short time in backups and provider systems and anything we must keep by law, as described in our Privacy Policy. Photos that the AI determines do not show food, and photos that cannot be analyzed, are deleted automatically.

You confirm that you have the rights needed to upload your content and that it does not break the law or infringe anyone else's rights. Please do not upload photos of other people, documents or other personal information.

If you send us ideas or feedback, we may use them to improve Weight Class without any obligation to you. You do not have to send us feedback, and we appreciate it when you do.

8. Acceptable use

When using Weight Class, you agree not to:

  • break any law or infringe anyone's rights, including privacy and intellectual property rights;
  • upload content that is illegal, sexually explicit, violent, hateful or harassing, or that shows other people without their permission;
  • use the scan feature for anything other than photos of food and drinks;
  • access or use the Service through bots, scrapers or other automated means, or in any way other than through the interfaces we provide;
  • interfere with or disrupt the Service or its infrastructure, upload malware, or try to get around our security or usage limits;
  • probe or test the Service for vulnerabilities without our permission (if you find a security issue, please report it to us privately);
  • copy, reverse engineer, decompile or disassemble the app, except to the extent the law expressly allows this despite this restriction;
  • misuse the AI features, for example by trying to extract our instructions or prompts, or by generating large volumes of requests;
  • sell, resell, rent or otherwise commercially exploit the Service, or use it to build a competing product;
  • impersonate another person or use someone else's account.

9. Intellectual property

The Service, including the app, software, design, text and graphics, and the Weight Class name and logo, is owned by us or our licensors and is protected by intellectual property laws. Your content remains yours, as described in Section 7.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable license to download and use the Weight Class app on devices that you own or control, for your own personal, non-commercial use. We reserve all rights not expressly granted in these Terms.

The app includes open-source software components that are licensed under their own terms. Nothing in these Terms limits your rights under those licenses.

Food data comes from the USDA FoodData Central database (public domain) and, for packaged products, from Open Food Facts (openfoodfacts.org), whose database is available under the Open Database License. Product data can be incomplete or out of date; check the package when it matters to you.

10. Free service and future paid features

Weight Class is currently free to use and contains no ads. In the future, we may offer optional paid features, such as a subscription. If we do, we will clearly show you the price and terms before you buy, and you will only be charged if you agree to the purchase.

Purchases made through an app store are processed by that store and are also subject to its terms and refund policies. If we ever move a feature that is currently free into a paid plan, we will tell you in advance.

Where the app offers Weight Class Premium, it is an optional subscription that removes the daily limit on AI scans (subject to a fair-use limit). The free plan keeps a number of AI scans a day and everything else: barcode scanning, food search, your calorie and macro goals, water, weight and supplements. The price, the length of the period and any free trial are shown in the app before you subscribe. Payment is charged to your Apple or Google account, and the subscription renews automatically unless you cancel it at least 24 hours before the end of the current period (or the free trial). You can cancel at any time in your App Store or Google Play settings; Premium then stays active until the end of the period you paid for.

11. Third-party services and app stores

The Service relies on third-party services, including the service providers listed in our Privacy Policy and the app stores that distribute Weight Class (the Apple App Store and Google Play). Your use of an app store is also subject to that store's own terms. We are not responsible for third-party services that we do not control.

If you downloaded Weight Class from an app store, you also acknowledge that:

  • these Terms are between you and us only, not the app store operator, and we, not the app store operator, are responsible for the app and its content;
  • the app store operator has no obligation to provide maintenance or support for the app;
  • to the extent permitted by law, the app store operator has no warranty obligation for the app, other than any refund it may offer under its own policies;
  • we, not the app store operator, are responsible for handling any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims and claims that the app infringes someone's intellectual property rights;
  • you are not located in a country subject to a government embargo, and you are not on any government list of prohibited or restricted parties;
  • you will comply with the app store's terms of use when using the app; and
  • the app store operator and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Termination and account deletion

You can stop using Weight Class at any time. To delete your account, open Profile in the app, tap Delete account and confirm. This permanently deletes your account, your profile and plan, all logged meals and all meal photos, as described in our Privacy Policy. It cannot be undone.

We may suspend or end your access to the Service if you seriously or repeatedly break these Terms, if we are required to do so by law, or if it is necessary to protect other users, the Service or us. Where appropriate, we will tell you why and give you a chance to fix the problem first. If we decide to discontinue the Service entirely, we will give you reasonable advance notice where we can.

When your account ends, your right to use the Service ends too. Sections that by their nature should continue to apply will continue to apply, including Sections 5 and 6, Section 7 (to the extent described there), Section 9 and Sections 13 to 18.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy.

In particular, we do not promise that the Service will be uninterrupted, secure or error-free, that AI estimates or plans will be accurate or complete, or that you will achieve any particular health, weight or fitness result.

Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you. If you are a consumer, you may have statutory rights, for example to digital content that conforms to its description, and nothing in these Terms affects those rights.

14. Limitation of liability

To the fullest extent permitted by law, we and our affiliates, officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim and (b) 100 US dollars (or the equivalent in your local currency).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be excluded or limited by law. If you are a consumer in the European Union or the United Kingdom, these limits do not affect your mandatory statutory rights.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless us and our affiliates, officers, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to your content, your misuse of the Service, or your breach of these Terms, the law or the rights of others. This does not apply to the extent that a claim was caused by our own breach, negligence or misconduct.

16. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you have a concern, please contact us first at support@ugcmediakits.com. Most issues can be resolved quickly this way, and we will try in good faith to resolve yours within 30 days.

If we cannot resolve a dispute informally, it will be decided exclusively by the courts located in the State of Georgia, United States. However, if you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also bring proceedings in the courts of that country.

17. Changes to these Terms

We may update these Terms from time to time, for example to reflect new features or changes in the law. We will post the updated Terms on this page and change the "Last updated" date at the top. If a change is significant, we will let you know in the app or by email at least 14 days before it takes effect, unless the change is required by law or needed urgently for security reasons.

If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree with them, please stop using the Service and delete your account.

18. General terms

  • Entire agreement. These Terms, together with our Privacy Policy and any additional terms we show you for specific features, are the entire agreement between you and us about the Service.
  • Severability. If any part of these Terms is found to be unenforceable, the rest remains in effect, and the unenforceable part will be applied to the greatest extent allowed.
  • No waiver. If we do not enforce a right or provision, that does not mean we have waived it.
  • Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours as part of a merger, acquisition or sale of assets, or to an affiliate, as long as your rights under these Terms are not reduced.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of third-party services, natural disasters or network failures.
  • Notices. We may send you notices in the app or to the email address linked to your account. You can send notices to us at the contact details below.
  • Language. These Terms are written in English. If we provide a translation and there is a conflict, the English version applies to the extent permitted by law.
